BHguns.net User Listing Terms

These User Listing Terms (the “Terms”) are an agreement between you and Force Protection Agency Inc., doing business as Beverly Hills Guns (“Beverly Hills Guns,” “BHG,” “BHguns.net,” “we,” “us,” or “our”). BHguns.net is a user-listing service operated in connection with the Beverly Hills Guns retail store and licensed-firearms-dealer operations.

1. Agreement, eligibility to use the service, and scope

You must be at least 21 years old and legally capable of entering a binding contract to create or use a BHguns.net account. This service is not directed to children, and no person under 21 may register, list, message, make an offer, or start a transfer through it.

These Terms supplement the Beverly Hills Guns account terms, privacy policy, appointment policies, posted store policies, and documents signed during a regulated transaction. If a conflict concerns the legal processing, custody, or delivery of a firearm, applicable law and the transaction documents control. If you do not agree, do not use BHguns.net.

2. What BHguns.net does—and does not do

BHguns.net provides technology through which users may publish descriptions of their own items, discover user-posted items, communicate, and request an appointment at Beverly Hills Guns. BHG is not the seller, buyer, owner, auctioneer, broker, consignee, appraiser, inspector, authenticator, guarantor, escrow holder, payment processor, or agent of either user with respect to the private item agreement unless BHG separately agrees in a signed writing.

A listing, message, displayed price, offer, appointment request, rating, or staff communication does not create a sale, reserve an item, establish title, guarantee eligibility, or obligate BHG to process or complete a transfer. Buyers and sellers contract with each other, not with BHG, concerning the item and its private price. BHG’s separate role as a licensed dealer begins only when BHG accepts the parties and item for processing.

3. One Beverly Hills Guns account; true legal identity

Your BHguns.net access is part of your Beverly Hills Guns customer account. You must provide your complete, current, and accurate legal name, date of birth, residential address, email address, telephone number, and any other requested information. The name and identifying information presented in person must match your valid government-issued identification and transaction records.

You may select a privacy-protective public display name for BHguns.net. That public name does not replace your legal identity in the private Beverly Hills Guns customer record. You may not give BHG an alias or nickname in place of your legal name, use a false address, borrowed identity, shared account, duplicate account intended to avoid enforcement, or another person’s credentials. You must keep account information current, protect your credentials, promptly report unauthorized access, and accept responsibility for activity under your account.

Public display names must be unique and may not contain contact information, impersonate another person or business, suggest that you are BHG staff, mislead other users, or contain unlawful, threatening, hateful, sexually explicit, or abusive language. BHG may reject, replace, or restrict a public name. Name changes are normally limited to once every 90 days, and prior names are retained privately for fraud prevention, moderation, dispute handling, and account continuity.

BHG may display an “Identity on File” or similar badge when it maintains the member’s legal customer identity. The badge is not an endorsement, guarantee, background-check approval, or determination that the member is currently eligible for any firearm or transaction. When a buyer and seller schedule a BHG transfer, BHG may reveal their legal names privately to one another for that transaction. Legal names are not placed on the public listing, public member profile, or public search metadata.

We may require identity, age, address, ownership, eligibility, or account verification before permitting any action. We may compare and associate BHguns.net activity with existing Beverly Hills Guns customer records and correct, merge, or restrict duplicate records.

4. Continuing legal-eligibility representations

Each time you use the service, you represent and warrant that:

you are not prohibited by federal, California, or other applicable law from possessing, receiving, purchasing, owning, selling, transferring, or having custody or control of the firearm, ammunition, magazine, or other regulated item involved;
you are not acting for an undisclosed person, prohibited person, or person who does not want their identity associated with the transaction, and you will not participate in a straw purchase or transfer;
you have no knowledge of a pending order, charge, conviction, mental-health prohibition, immigration restriction, controlled-substance status, probation condition, or other circumstance that makes your representation false or gives you reason to believe the transaction or return will be rejected, delayed, denied, or unlawful;
all answers and documents supplied online, to BHG, on federal or state forms, and during the DROS process will be complete and truthful; and
you will immediately stop using the service and notify BHG if your eligibility or any material answer changes before delivery or return.

These are your representations, not a preapproval by BHG. Only the responsible government agencies and BHG acting under law may determine whether a particular transfer can proceed. A California Personal Firearms Eligibility Check does not include every federal check and does not guarantee approval of a later transaction.

5. Seller ownership, listing accuracy, and lawful items

A seller must own the item, possess it lawfully, have unrestricted authority to transfer it, and disclose every fact that would reasonably affect legality, identity, safety, function, or value. Descriptions and photographs must accurately show the actual item and its material condition, modifications, damage, malfunctions, missing parts, recalls known to the seller, included accessories, serial-number status, and provenance. You may not conceal a defect, use stock photographs deceptively, manipulate an image to misrepresent condition, list an item already promised or transferred, or claim a roster or exemption status you cannot substantiate.

Every item identified as included or optional is part of the seller’s own offer and representations. The seller must accurately state its identity, quantity, condition, capacity, round count, compatibility, and additional asking amount. BHG does not sell, price, bundle, reserve, or collect payment for those seller-provided items. A separate firearm may not be presented as an accessory or optional item and must have its own complete listing and transfer record.

Do not publish a full serial number, government ID, home address, DROS document, payment credential, or other sensitive record. You must provide required records privately to BHG through approved channels.

Items and conduct prohibited on BHguns.net

You may not list, seek, offer, or arrange any item or transaction that is unlawful in any relevant jurisdiction or that BHG decides it cannot safely or lawfully process. Prohibited content includes, without limitation:

stolen, fraudulently obtained, unlawfully possessed, misappropriated, counterfeit, or encumbered property;
a firearm with an altered, removed, obliterated, or unlawful serial number, or a self-manufactured or self-assembled firearm offered for transfer;
an assault weapon, machinegun, suppressor, short-barreled rifle or shotgun, destructive device, undetectable firearm, unlawfully configured firearm, or unregistered National Firearms Act item;
a large-capacity magazine, armor-piercing ammunition, explosive or incendiary item, conversion device, or part or combination of parts intended to create an unlawful weapon;
an item subject to a recall or safety notice when transfer is prohibited, or an item the seller knows is unsafe without prominent disclosure;
requests to ship or deliver a firearm outside the required licensed-dealer process, evade DROS, falsify price or parties, structure a straw transaction, or complete a transfer away from Beverly Hills Guns without BHG’s prior written approval; and
fraud, threats, harassment, discriminatory or obscene content, spam, commercial inventory presented as a private sale, unauthorized solicitation, or an attempt to move communications off-platform to evade safety controls or fees.

The absence of an item from this list does not mean it is lawful or accepted. BHG may demand documentation, decline any category, or impose a more restrictive policy than the law requires.

6. Independent buyer and seller responsibilities

Seller duties

Confirm the buyer shown in the BHG workflow is the actual transferee and do not deliver a regulated item directly to the buyer.
Transport, store, and present the unloaded firearm lawfully, in the required container, with all required identification and documentation.
Remain available throughout processing and promptly respond if the firearm must be corrected, retrieved, transferred to a lawful designee, or surrendered.
Do not treat a background-check delay or denial as BHG’s purchase of, acceptance of title to, or responsibility to sell the item.

Mandatory protective-case and store-custody policy

No bare or loose firearm will be accepted for a BHguns.net-connected transfer. Every firearm must arrive unloaded and fully enclosed in a properly sized protective firearm case, gun bag, or secure-closing protective sleeve that reasonably protects the firearm’s finish, sights, controls, barrel, frame, and stock from movement, impact, abrasion, or contact with other property. The original factory case is preferred. Cardboard shipping boxes, open racks, blankets, towels, ordinary backpacks, uncovered scabbards, and improvised wrapping do not satisfy this policy unless BHG expressly approves them in advance.

The protective case is part of the custody package and must remain with the firearm continuously from initial store acceptance through delivery to the buyer, lawful return to the seller, or other authorized disposition. A seller may not remove or reclaim the case while BHG retains the firearm. If the seller intends to keep a case, the buyer or seller must supply an acceptable replacement at initial intake before BHG accepts custody. The party receiving the firearm must leave with it in the case.

This protective-case policy is separate from—and does not replace—any firearm safety device, cable lock, trigger lock, safe-handling, or lawful-transport requirement. California DOJ states that handguns generally must be transported unloaded in a fully enclosed locked container or locked vehicle trunk; rifles and shotguns generally must be unloaded, while registered assault weapons have additional locked-container and destination restrictions. BHG may require a more protective or secure container than the legal minimum and may refuse a damaged, wet, contaminated, insecure, undersized, nonclosing, or otherwise unsuitable case.

Buyer duties

Investigate the item, seller, price, condition, history, compatibility, legality, recalls, and manufacturer support before agreeing to proceed.
Appear personally with current qualifying identification, proof of residency when required, a valid Firearm Safety Certificate or documented exemption, and every other required document.
Be the actual purchaser/transferee; provide only your own funds and information unless a lawful arrangement is fully disclosed and approved by BHG.
Understand that payment to the seller, a passed eligibility check, or an appointment does not require BHG to deliver an item that cannot legally or safely be delivered.

7. Beverly Hills Guns transfer process

Unless BHG gives prior written permission or declines the item or transaction, any firearm connection made through BHguns.net must be presented to and processed in person by Beverly Hills Guns. California generally requires private-party firearm transfers to be conducted with both parties in person through a licensed California dealer using DROS. Applicable identification, residency, Firearm Safety Certificate, safe-handling demonstration, safety-device, waiting-period, age, frequency, and other requirements remain in force.

Store-specific use; no forced transaction

BHguns.net is a Beverly Hills Guns store-specific connection service, not a general advertising service for arranging the same transaction at another dealer. A seller may remove a listing before a BHguns.net user has contacted the seller about it, and either user may stop discussions, reject an offer, decline to buy or sell, or abandon a proposed transaction at any time. Nothing in these Terms requires either user to enter into or complete a private sale.

However, when a buyer and seller are first introduced through a BHguns.net listing, neither user may deliberately use the listing, account information, messages, appointment tools, or other BHguns.net resources to route that same proposed transaction through another dealer for the purpose of avoiding Beverly Hills Guns, its disclosed workflow, or a disclosed BHG service fee. This limited rule applies to that specific BHguns-introduced buyer, seller, and item while they continue pursuing the proposed transaction, including after the listing is hidden or removed. It does not restrict an unrelated transaction or prevent either user from ending the proposed transaction without penalty.

The rule does not apply if Beverly Hills Guns declines or is unable to process the item or parties, gives prior written permission, or applicable law requires a different lawful process. BHG’s remedy for a suspected violation is limited to reasonable service-protection measures such as investigating the activity, removing listings, restricting or terminating BHguns.net access, declining future service, and collecting only a fee that was separately disclosed and otherwise lawfully earned. This provision does not create a sale, make BHG a party to the users’ private agreement, or authorize BHG to collect the private item price.

Ammunition described as included, complimentary, thrown in, bundled, or optional remains subject to BHG acceptance and every applicable ammunition-vendor, eligibility, identification, delivery, recordkeeping, and fee requirement. Listing ammunition with a firearm does not authorize its transfer or make it part of the firearm DROS.

BHG may inspect identifying characteristics for compliance and recordkeeping, but that is not a mechanical inspection or appraisal. BHG may refuse or pause processing because of item configuration, identification, documentation, safety, capacity, staffing, government-system status, suspected fraud, legal uncertainty, or store policy. The parties must not leave an item unless BHG expressly accepts custody and creates the required record.

The statutory waiting period is generally ten 24-hour periods after DOJ accepts the DROS, but a delay, rejection, denial, undetermined status, expired DROS, documentation issue, or legal hold may extend or prevent delivery. A firearm may not be delivered merely because time has passed.

8. Buyer delay, rejection, denial, failure to pick up, and return to seller

If the firearm cannot legally be delivered to the buyer, California Penal Code section 28050 generally directs the dealer to return it to the seller promptly—but only when returning it to that seller is lawful. The seller is not automatically entitled to walk out with the firearm. The seller must personally appear, present acceptable identification, complete all required forms, remain legally eligible, and satisfy the applicable federal, state, DOJ, and dealer requirements for return.

Depending on the DROS status and timing, DOJ may require BHG to obtain a seller NICS Transaction Number (“NTN”) or process a new Return to Owner DROS. DOJ states that a seller NTN is available for an associated buyer DROS with an Undetermined, Rejected, or Denied status; if that DROS is cancelled or the specified delivery/return window has expired, the seller NTN is no longer valid and a Return to Owner DROS is required. Additional processing time, background review, documents, and lawful fees may apply.

If BHG cannot legally return the firearm to the seller, current Penal Code section 28050 permits the seller to request that the dealer retain it for up to 45 days, in addition to waiting and processing time, while the seller designates another person who may lawfully receive it through the required process. If no timely hold is requested, no lawful designee completes the process, or delivery remains unlawful, BHG may be required to deliver the firearm to the sheriff or local police for disposition. BHG has no authority to override DOJ, NICS, a court order, or statutory disposition.

A buyer who is delayed, rejected, denied, becomes ineligible, abandons the transaction, supplies deficient documents, or fails to pick up remains responsible to the seller for consequences under their private agreement. A seller remains responsible for timely cooperation and lawful recovery or designation. BHG is not liable for loss of the parties’ bargain, private payments, price changes, travel, delay, storage, government action, required surrender, or inability to return or deliver, except to the extent liability cannot lawfully be excluded.

9. Item condition, inspection, safety, warranties, and private returns

User-posted items are offered by their owners, not by BHG. Unless BHG separately sells an item on a BHG invoice with an express written warranty, every user-posted item is presented “as is” and “with all faults” as between BHG and the users. BHG does not warrant title, authenticity, merchantability, fitness for a particular purpose, accuracy, safety, operability, caliber, headspace, modification quality, round count, recall status, regulatory classification, value, or that photographs and statements are accurate.

Never rely on a listing as a safety inspection. Before use, the buyer should have a qualified gunsmith inspect any used, modified, damaged, unfamiliar, or recalled firearm and should follow the manufacturer’s current instructions. Users must independently check manufacturer recalls and safety notices.

Disputes about condition, defects, misrepresentation, repair, warranty, refund, rescission, or the private price are solely between buyer and seller and, when applicable, the manufacturer or repair provider. BHG does not owe or control a refund of the private item price. A buyer may not simply hand a firearm back to a seller; any return or replacement must be separately reviewed and transferred through a licensed dealer whenever law requires.

10. Private item payment, taxes, and BHG fees

BHG does not collect, transmit, hold, finance, insure, guarantee, refund, charge back, or provide escrow for the private item price. Users arrange any lawful payment directly and at their own risk. Do not send cash, gift cards, cryptocurrency, credentials, or deposits to a person you have not verified. Each user is responsible for their own tax, reporting, licensing, and recordkeeping obligations; BHG does not provide tax advice concerning the users’ private agreement.

BHG may charge separately disclosed fees for its own services. When enabled, a flat BHguns.net listing-service fee is disclosed to the seller before publication and recorded with that listing. It is not a commission or percentage of the private item price and is due from the seller only when the buyer connected through that listing completes the related store transfer appointment. It is separate from DROS, statutory private-party-transfer, storage, Return to Owner, gunsmith, or other store fees. Publishing remains free unless the listing form expressly states otherwise.

Government charges and legally permitted dealer charges are determined under the law and policies in effect when service is performed. The displayed asking price does not include BHG or government fees. BHG may waive its own listing-service fee in writing but cannot waive government requirements or charges.

11. Appointments, cancellations, no-shows, and completion status

An appointment request is conditional and may be rescheduled or declined. Users must provide accurate availability and promptly cancel if they cannot appear. Repeated no-shows, abusive cancellations, attempts to bypass BHG after using the service, or false completion claims may result in account restrictions.

The website may automatically mark a listing closed when store staff record the associated appointment as completed. That status is an operational record, not a warranty that every private obligation was performed. Users may not manipulate status, reviews, appointments, or accounts to fabricate a transaction or avoid a fee.

12. Messages, offers, ratings, and reviews

Messages must concern the listed item and remain lawful, professional, and free of threats, harassment, hate, obscenity, spam, fraud, or sensitive identification and payment data. BHG may use automated and human review, preserve communications, and disclose them when required by law or reasonably necessary to investigate safety, fraud, or Terms violations.

Ratings and reviews must be based on a genuine completed connection, describe firsthand experience, and be truthful, relevant, and non-retaliatory. No user may buy, sell, trade, coerce, suppress, manipulate, or fabricate a rating. BHG may remove content that violates these rules but does not promise to resolve factual disputes or remove an unfavorable review merely because it is disputed.

13. User content and intellectual property

You retain ownership of content you lawfully own. You grant BHG a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, resize, adapt for display, publish, distribute, moderate, preserve, and use your listing content to operate, secure, document, and promote BHguns.net and the listed item. You represent that the content is yours or properly licensed and does not violate privacy, publicity, trademark, copyright, or other rights.

BHguns.net, its design, software, branding, and BHG-created content are owned by or licensed to BHG. You may not scrape, copy, reverse engineer, interfere with, frame, impersonate, exploit, or use automated means against the service without written permission.

14. Privacy, records, and electronic communications

Our Privacy Policy explains how information is handled. You authorize BHG to associate BHguns.net activity with your Beverly Hills Guns customer profile; verify identity and transaction information; preserve listings, acceptances, messages, appointments, ratings, device and access records; and use or disclose records for operations, safety, fraud prevention, legal compliance, and disputes.

You consent to receive service messages electronically, including account, listing, message, appointment, cancellation, completion, fee, safety, moderation, and review notices. Available email and text preferences may be managed in your profile, but BHG may send nonmarketing communications required to operate an active transaction, protect safety, or comply with law.

15. Monitoring, refusal, suspension, and cooperation

BHG may investigate, verify, reject, hide, edit for formatting, expire, preserve, or remove any listing or content; refuse any item or person; limit features; cancel an appointment; suspend or terminate an account; and take other reasonable action at any time for safety, legal compliance, operational risk, suspected fraud, or violation of these Terms. We do not undertake a duty to monitor every listing or message.

We may preserve evidence and cooperate with DOJ, ATF, law enforcement, courts, regulators, payment providers, manufacturers, or affected persons when required by law or when we reasonably believe disclosure is necessary to address fraud, threats, stolen property, prohibited possession, unsafe items, or legal process. Do not use BHguns.net to test law-enforcement attention or seek advice on evading law.

16. Third-party services and no professional advice

Links, maps, identity services, messaging carriers, payment tools used for BHG’s own fees, government systems, and manufacturer resources are controlled by third parties. BHG is not responsible for their availability, accuracy, or conduct. Website content is general information, not legal, tax, safety, appraisal, or gunsmith advice. Laws change and individual facts matter; users must obtain qualified advice when needed.

17. Disclaimer of service warranties

To the fullest extent permitted by law, BHguns.net and all user content are provided “as is” and “as available.” BHG disclaims all express, implied, and statutory warranties concerning the listing service, including availability, security, uninterrupted operation, accuracy, noninfringement, merchantability, fitness for a particular purpose, and any warranty arising from course of dealing or usage. We do not guarantee that a user is truthful, an item exists or is lawful, an offer will be honored, a transfer will be approved, or a dispute will be resolved.

18. Release between users

You release BHG and its owners, officers, employees, contractors, affiliates, insurers, licensors, and agents from claims arising from or relating to another user, a private agreement, private payment, item condition, listing statement, failed or abandoned transaction, or user dispute, except for claims that cannot lawfully be released. To the fullest extent permitted by law, you waive the protections of California Civil Code section 1542 and any similar law concerning unknown claims, meaning this release is intended to cover claims you do not presently know or suspect exist and that, if known, might have materially affected your agreement to the release.

19. Limitation of liability

To the fullest extent permitted by law, BHG will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, bargain, data, goodwill, use, or opportunity; personal travel or delay costs; private payments; property defects; or government or third-party action arising from BHguns.net, even if advised that such loss is possible. BHG’s aggregate liability arising from the listing service will not exceed the greater of the BHG listing-service fees you paid during the twelve months before the event giving rise to the claim or $100.

These limitations do not exclude liability that California law does not permit BHG to exclude, including liability finally determined to result from BHG’s fraud, willful injury, or other nonwaivable conduct. They do not alter any separate express written warranty BHG gives for an item BHG itself sells.

20. Indemnity

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless BHG and its owners, officers, employees, contractors, affiliates, insurers, licensors, and agents from third-party claims, investigations, losses, liabilities, judgments, penalties, and reasonable attorneys’ fees arising from your listing, item, content, private agreement, payment, possession, transport, storage, use, transfer, misrepresentation, violation of law, violation of these Terms, or infringement of another person’s rights. BHG may control the defense of a covered matter, and you may not settle it in a manner that admits fault by or imposes obligations on BHG without written consent.

21. Governing law and disputes

Before filing a claim concerning BHguns.net, you agree to send a written description and requested resolution to the contact below and allow 30 days for an informal response, unless immediate filing is necessary to preserve a claim or seek urgent lawful relief. California law governs these Terms without regard to conflict-of-law rules. Any court proceeding must be brought exclusively in the state or federal courts located in Los Angeles County, California, and each party consents to personal jurisdiction and venue there, except where applicable consumer law requires otherwise.

22. Changes, severability, assignment, and survival

We may revise these Terms for legal, safety, or operational reasons. The effective date and version will identify the current agreement. When a material revision applies to continuing use, we may require a new affirmative acceptance. Changes do not retroactively alter a completed private agreement unless law requires it.

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign your account or these Terms; BHG may assign them as part of a reorganization, financing, sale, or transfer of the service. Provisions that by their nature should survive—including ownership, records, fees, releases, disclaimers, liability limits, indemnity, and disputes—survive termination.

23. Entire agreement and contact

These Terms and the incorporated policies are the entire agreement concerning BHguns.net’s user-listing service and supersede prior statements on that subject. No user, employee, or message changes them unless an authorized BHG representative signs a written amendment.
